IIRC, Soup had an article where DMG stated exactly what Suzuki needed to provide in order to win their appeal. They basically said "Show us a US street bike that has the same crank and everything's jake" but Suzuki couldn't do that.
But Spies winning race 2 at Road A basically made it moot. Spies wins the championship anyways.

Having read both the ama releases as they were posted at SOUP, it sounds like they have now back tracked on their biggest assertion. The first statement and the reason, I thought, that they rejected the appeal so quickly was "give us a Suzuki street bike with this crank in it from Suzuki". This new release says give us that or give us a distribution point to get one. So I don't know if the first release had some creative editing to support a point, which doesn't seem likely but is all to common, or if they want to sound fair now. Either way that first angry sounding statement sure didn't help them win me over to the "we're just enforcing the rules" argument.

Mat had an illegal crank and should have been penalized, period. I dont see why there is a fuss about this.

Because of the way it was handled. Even Some AMA reps said they could have done things better. Not allowing an appeal didn't help the AMA at all going into what will surely be a weak 2009 season for them.

The whole team has had illegal crankshafts since at least Fontana, maybe long before. They were inspected at least twice (once for each rider) before VIR yet dmg singled out Mladin. That is the problem.

They allowed the appeal but Suzuki failed to produce hardly anything they were asked to produce,hence they lost their appeal.

And you know this how?
Through an employee of an aftermarket company. His info has been 100% accurate since I was introduced to him. He has a close friend on the team and he talked to him at Road Atlanta.
By the way the mechanics didn’t know the cranks were illegal. They were given the parts and didn’t have time to worry about where they came from. And he didn’t have contract for 2009 as of Road Atlanta.

You do have to think that the mechanics thought the cranks were legal and that the DQ would be overturned, otherwise why would they show up at the next round using them in both Matt and Tommy's bikes? With all the controversy they had to know they would be inspected again and wouldn't be able to sneek something through.
