Following declarations from Spyker's Colin Kolles and Williams' Frank Williams that they're ready to challenge the legality of Toro Rosso's upcoming STR2 – expected to be a slightly reworked version of Red Bull Racing's new RB3 – STR co-owner Gerhard Berger affirmed that he's ready to fight the rival squads in court.

"We checked very carefully on the legal side, on the FIA side; we have checked very carefully the wording of the Concorde Agreement, and it shows very clearly to us that what we are doing is absolutely correct - that we are inside the regulations," Berger told Formula 1's official website.

"It is not up to [Williams and Spyker] to judge whether what we are doing is right or wrong. I respect
their comments, but in our view we are a hundred percent fine. They fear our competitiveness. If they want to go to court, fine, then we will fight it out.

"But again, we checked our situation very carefully, and we don't see the slightest hint that we are not fulfilling the wording of the regulations."

Berger also insisted that even if his operation wanted to go on a different path now, it couldn't, as the whole development of the STR2 is being made based on the design whose intellectual properties are owned by Red Bull Technology – not Red Bull Racing – and thus, in his interpretation of the rules, entirely legal.

"We went on a route that even if we wanted we could not go back. It is done."
